5. REFUNDS & CANCELLATIONS BY PASSENGER

You may not be entitled to a refund if you change or cancel your plans after confirmation of a booking. All cancellation requests must be sent to Hearth & Compass in writing via email to journeys@hearthandcompass.com and will be processed upon receipt.

  • More than 24 hours before scheduled service: Fully Refundable.

  • Less than 24 hours but more than 2 hours before scheduled service: 50% cancellation charge.

  • Within 2 hours of scheduled service: 100% cancellation charge.

  • No-show: 100% cancellation charge.

Cancellation fees will be charged to the credit card or other payment method you authorized to pay for transportation services. Additional cancellation and no-show policies will be listed in your quote for long distances, hourly or special transportation services. You are considered a “No show” if Hearth & Compass has arrived at your designated pick-up location and is unable to reach you within 15 minutes by phone, text or email. For airport pickups, the 90-minute period below will apply.

6. CHANGES TO RESERVATION

Requests to change a pickup time, location, destination, passenger count, vehicle, service type, or other material aspect of a reservation are subject to availability and may result in additional charges. If a requested change materially affects the distance, duration, service type, or cost of the transportation, Hearth & Compass may provide revised pricing. The revised reservation will not be confirmed until the Client approves the change and pays any additional amount required by Hearth & Compass. If the amount for the new reservation is less, you will receive a refund for the difference. If you change any component of your reservation, Hearth & Compass is not responsible for any additional costs resulting from changes requested by the Client. Requests to reschedule a reservation are subject to availability and may be subject to the cancellation and payment terms applicable to the original reservation.

7. AIRPORT TRANSPORTATION

For airport transportation, the Client is responsible for providing accurate flight information at the time of booking. Hearth & Compass will make reasonable efforts to monitor scheduled flight information and accommodate reasonable flight delays. If a flight delay prevents Hearth & Compass from reasonably maintaining the original pickup schedule your reservation may be cancelled. We recommend scheduling your pickup time 30 minutes following your flights arrival time. Hearth & Compass will wait up to 45 minutes from your scheduled pickup time. After 45 minutes from your scheduled pick-up time, your reservation will be considered cancelled. If a passenger requests or requires waiting beyond the included waiting period, additional waiting charges may apply. A significant flight delay may conflict with another scheduled reservation. For arrivals, it is strongly recommended that you to arrive at the airport a minimum of 2 hours prior to scheduled departure for domestic flights and 3 hours prior to scheduled departure time for international flights. Please reconfirm your flight times at least 24 hours prior to scheduled departure time for domestic flights. Hearth & Compass is not responsible for missed flights, connections, events, or other arrangements resulting from flight delays, traffic, weather, or other circumstances beyond its reasonable control.

8. FORCE MAJEURE AND OTHER CANCELLATIONS BY HEARTH & COMPASS

In the event that a Force Majeure Event results in cancellation, you will receive a full refund for the services booked.

9. PASSENGER CONDUCT

Baggage and personal effects are at all times the sole responsibility of the passenger at all times. Any transportation, possession or use of illegal drugs will result in immediate termination of your trip. No refund will be provided in such circumstances. Passenger will reimburse Company for all reasonable and documented costs associated with cleaning the vehicle if the vehicle is soiled or damaged due to food, drinks, or bodily fluids.

You must indemnify us for the full amount of any claim (including attorneys’ fees and other legal costs) made against us because of your conduct. To the extent permitted by applicable law, Client agrees to indemnify and hold harmless Hearth & Compass and its owners, employees, drivers, and representatives from claims, damages, losses, costs, and expenses, including reasonable attorneys' fees, arising from Client's or a passenger's negligent, reckless, unlawful, or intentional acts or omissions, including damage to the vehicle or property.

Please advise us in advance regarding luggage transportation needs. Hearth & Compass may refuse or limit luggage that cannot be safely transported. When at capacity, the vehicle can accommodate up to six carry-on bags and six personal items. Client is responsible for advising Company in advance of the amount of luggage so Company can confirm whether it can be accommodated.

Hearth & Compass reserves the right to substitute a substantially similar vehicle or appropriately licensed and insured third-party transportation provider when reasonably necessary due to the vehicles unavailability, maintenance, or other circumstances.

Small household pets may be transported only with advance approval from Hearth & Compass and may be subject to reasonable conditions regarding the method of transportation and protection of the vehicle. Passengers are responsible for ensuring that pets are safely contained and do not damage the vehicle or create a safety or sanitation concern. Cleaning or damage charges may apply. Passengers traveling with children who require a car seat are responsible for providing accurate information regarding the child's age, height, weight, and necessary child car-seat requirements and Hearth & Compass will make best efforts to accommodate. Passengers may need to provide their own child safety restraints. Hearth & Compass does not transport unaccompanied minors.

11. LIMITATION ON LIABILITY

To the maximum extent permitted by applicable law, Hearth & Compass will not be liable for indirect, incidental, special, consequential, or punitive damages, including missed events, missed connections, or other consequential losses arising from a delay, cancellation, modification, or failure to provide transportation services, except to the extent such limitation is prohibited by law.

Hearth & Compass shall not be responsible for delays, cancellations, or other failures in service resulting from traffic, road closures, weather, mechanical or vehicle issues, accidents, governmental actions, emergencies, acts of God, or other circumstances beyond Hearth & Compass's reasonable control, except as otherwise required by applicable law. Hearth & Compass shall not be responsible for loss of or damage to luggage, personal property, or other items left in a vehicle. Nothing in these Terms shall be construed to exclude or limit liability for personal injury, death, gross negligence, willful misconduct, or any other liability that cannot lawfully be excluded or limited under applicable law.

12. RESERVATION OF RIGHTS: CHANGES TO THESE TERMS

We reserve the right, in our sole discretion, to change these Terms and Conditions at any time. Updated versions of the Terms will be provided to Clients, will be posted on our website and are effective immediately on posting.

13. DISPUTE RESOLUTION

Any dispute between the trip participant and Hearth & Compass, directly or indirectly relating to the Terms and/or to the trip undertaken, shall be first submitted to mediation in Rutherford County, Tennessee before a mediator mutually agreed to by the parties.

Tennessee law governs this contract and all proceedings arising out of or related to this agreement. All trip participants agree that Tennessee shall be the sole and exclusive venue for any such action and hereby consent to the jurisdiction of the Tennessee courts for such action.

Any claim against Hearth & Compass must be brought within 12 months after the date of the completion of the trip and not later. Neither the parties nor any affiliate of Hearth & Compass shall in any case be liable for damages other than compensatory damages, and the parties hereby waive any right to claim punitive or exemplary damages. The parties further agree that claims may be brought by parties only in their individual capacities and not as plaintiffs or class members in any class action, proposed or purported class action, or other representative action, regardless of the type of proceeding. These Terms and Conditions (and any other terms and conditions referenced in these Terms) constitute the entire agreement between the Client and Hearth & Compass with respect to travel bookings made with Hearth & Compass by any means, and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between Client and Hearth & Compass with respect to communications with Hearth & Compass.
